Field Sobriety Test

Have you been arrested for drunk driving after failing a field sobriety test? Do not let your failed tests discourage you. You can still build a comprehensive DUI defense, and in many cases, the results of these tests are thrown out in court. From my offices in Walnut Creek, I protect the rights of the accused facing drunk driving charges in San Francisco area courts.

If you are pulled over and the police suspect you of drinking and driving, under California law, you do not have to submit to field sobriety tests. No matter what the police may tell you, you have the right to refuse field sobriety tests. As a defense lawyer with over twenty-nine years of experience, I will make sure your rights are protected.

If you submitted to a series of field sobriety tests and failed them, you can still build a comprehensive defense. While the state of Texas does have standard field sobriety tests that some police officers use, many officers to not know how to properly administer these tests properly. If your tests were not conducted properly, the results could be thrown out in court.

Even when conducted properly, these tests are difficult to interpret. I will put the burden of proof on the prosecution and make sure you are not charged with a DUI based on failed roadside tests. Most drunk driving charges are based on more than just field sobriety tests. I will also consider the results of your blood or breath tests, in order to build the best possible criminal defense.
